1. Introduction

This website boomrealtys.com, including any subdomains thereof, and any other websites through which its services are made available, our mobile, tablet and other smart device applications, and application program interfaces etc, (hereinafter collectively referred to as "Boom Realtys") is owned, hosted and operated by Repute Real Estate (hereinafter referred to as RRE), a company incorporated in India under the Companies Act, 1956 and having its registered office at (Company address). These terms and conditions, privacy policy and community guidelines regulating use of these Services constitute a legally binding agreement between Boom Realtys and the User (the "Agreement").

Boom Realty and/or any other website(s) linked to this website is an online information and communications service provided to you, subject to your compliance with the terms and conditions set forth below.

RRE may amend/modify these terms and conditions at any time, and such modifications shall be effective immediately upon posting of the modified terms and conditions on Boom Realtys. You may review the modified terms and conditions periodically to be aware of such modifications and your continued access or use of Boom Realtys, shall be deemed conclusive proof of your acceptance of these terms and conditions, as amended/modified from time to time. RRE may also suspend the operation of Boom Realtys for support or technical upgradation, maintenance work, in order to update the content or for any other reason.

If you utilize Boom Realtys in a manner inconsistent with these terms and conditions, RRE may terminate your access, block your future access and/or seek such additional relief as the circumstances of your misuse may be deemed to be fit and proper.

2. Definitions

The term Subscriber/User would include any person, whether an individual or a legal entity who has subscribed to the Services of Boom Realtys (whether on a paid or free basis), and to whom the access to Boom Realtys is restricted by the use of a sign in user name and a password. The user name and password are either allotted by Boom Realtys or chosen by the Subscriber or agreed upon by Boom Realtys. It is made abundantly clear that only the authorized User has the right to access the Services so offered by Boom Realtys.

The term Browser/Visitor will mean and include a person who utilizes any of the Services offered by Boom Realtys, without the need or a requirement to create an account i.e. visits non-restricted portions of Boom Realtys. The term Advertiser would include a Subscriber/User uploading or relaying content using the Services.

The use and access to Boom Realtys shall be subject to these terms and conditions and community guidelines. For the purposes of this Agreement, any person who does not have a legal or a contractual right to access the Services, but does so, will fall within the definition of an 'unauthorized user' and will nevertheless be subject to the terms and conditions regulating the usage of Boom Realtys, and expressly so with respect to respecting the intellectual property rights of the RRE, and abiding by terms and conditions below mentioned.

The terms 'User' and 'Customer' would include both the Subscriber/Advertiser(s) and Browser/Visitor(s).

The terms 'Service' or 'Services' would mean to include the interactive online information service offered by Boom Realtys on the internet through which the user may access information carried by Boom Realtys in the database maintained by it. The terms would also include to mean the search tools through which the User can search through the hosted databases and information using a number of search tools that are present with a selection matching their search criteria. The term would also include services by way of space used by customers for advertisements such as listings and banners. Users then select one or more of the items presented to view the full document/ record. The term Service does not extend to Boom Realtys acting as an agent either express or implied on behalf of any User/Customer and is merely acting as a medium of information exchange.

The term RERDA shall mean and include the Real Estate (Regulation and Development) Act, 2016 as amended read with any rules or regulations that might be framed thereunder.

3. Submission and administration of listings/advertisements

User agrees not to submit any property descriptions, photographs, financial, contact or other information contained in each property's data to Boom Realtys unless the User submitting such a Listing/Advertisement has acquired and received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s) on the User's website or on Boom Realtys. Similarly, Boom Realtys does not take any ownership, directly or indirectly towards any person whatsoever, with respect to banners hosted on its website by its customers, which are strictly in the nature of sale of space by Boom Realtys & it has not carried out any independent verification on the authenticity or compliance requirements, as may have been required under any law for the time being in force, of such images/ banners/ listings. Some listings may contain third party audio/video content ("AV Content") provided for general informational purposes only and such content does not constitute a recommendation or solicitation or intends to influence any type of purchase or decision. No guarantees are made by Boom Realtys or the providers of the AV content as to its accuracy or completeness. The User agrees to the use of any content or information provided to RRE/Boom Realtys for promotional, marketing, and publicity purposes without any compensation. Where you provide us with voice samples or voice recordings to generate voiceovers for video listings, you provide us with a royalty-free, irrevocable, worldwide, sublicensable, and transferable right and license to use, modify, and further develop the voice samples and voice recordings in a manner that Boom Realtys deems fit. In case a User is covered under the RERDA, it shall obtain all requisite approvals, licenses and permits issued by the competent authorities with respect to the Project/Land/Apartment/Plot in the listing, by following the due process of law. Further, the User shall, at all times, remain in compliance with all applicable Laws in relation to the Project/Land/Apartment/Plot in the listing. The User shall disclose all material information as required by LMA and in respect of their registrations under RERDA and all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not. The User shall disclose all material factual information as regarding the property being advertised, its correct dimensions as also in respect of their registrations under RERDA and all such property(s) submitted including the present status and nature of such property and shall also disclose whether the property is free from all encumbrances or not. The User in addition shall furnish a brief background of such property in respect of title, ownership and possession, RRE may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time. The User may further be required to substantiate his claims as to the nature and status of the property by swearing an affidavit stating the authenticity of the information/data so provided/displayed. RRE may, at its sole discretion but without any obligation to, search for such and remove properties that are alleged to have been submitted in violation of this provision. In addition, RRE may require additional evidence of compliance with this provision from Users who are alleged to have submitted properties or other information/data in violation of these terms and conditions. RRE will, in its sole discretion, terminate the accounts of, and refuse Service to, any User who repeatedly or intentionally violates these terms and conditions. Additionally, the User agrees to allow the Property listing, or any part of it, to be searched, displayed, accessed, downloaded, copied, and otherwise referred to by users of the User's website or the Boom Realtys website. RRE shall have the sole authority to choose the manner in which any Property will be searchable, displayed, accessed, downloaded, copied, and otherwise used on Boom Realtys and RRE shall have the right to modify the property listing in the exercise of its rights under these terms and conditions. In addition to the terms aforementioned the User agrees

(a) To represent and warrant that all Properties and associated information provided by the User will be accurate; (b) That the User will not permit the posting of a property on Boom Realtys under a name other than the name of a real estate agent who has been duly authorized and engaged by the owner of the property in this regard;

RRE shall place the information relating to properties at defined sections of Boom Realtys or such other mirror or parallel site(s). RRE reserves, in a manner consistent with reasonable commercial business practices, the right to remove all or any part of the Properties posted on the User's website or on Boom Realtys without notice. RRE accepts no responsibility for checking/verifying the accuracy of reports or data files submitted by the User. While RRE shall take all reasonable efforts for data backup and business resumption, the User will be solely responsible for retaining back-up copies of all information, photographs and other materials furnished/submitted to Boom Realtys.

Users, who are buying/renting property/properties through Boom Realtys, must verify details the property/properties as well as its right, title, ownership, lien etc. on their own. The 'verified' tag visible on property/properties on Boom Realtys merely indicates the verification of the existence of the property in the manner it has been advertised. At no point shall the 'verified' tag be construed to be a verification of any documentation, ownership details, area or pricing details of the property/properties.

4. Content

We employ proprietary and third-party AI tools to identify and address harmful content on our platform. These tools are designed to take reasonable efforts towards detecting violations of platform terms and applicable laws, including harmful behavior such as speech that violates our platform terms. Automated moderation may operate automatically or with human oversight, depending on the complexity of the content and internal guidelines. Based on the output of technological moderation, content may be approved, rejected, or escalated to a second level of review by human moderators. These tools rely on third-party services to provide the detection and moderation capabilities.

Our automated tools function as part of a multi-layered moderation process. Please note that users have the right to raise grievances or appeal moderation decisions in accordance with our platform terms Grievances (link to grievances section) and such feedback will be reviewed in accordance with established timelines, including by human moderators where necessary.

These tools are part of our ongoing efforts to improve moderation capabilities and ensure compliance with legal and platform standards. While we endeavour to maintain accuracy and fairness, no system is perfect. The measures are implemented on an "as is" basis, and we will continue to refine them in collaboration with external service providers to better protect our community.

5. Payment Terms

• Payments for the Services offered by Boom Realtys shall be on a 100% advance basis. The payment for Service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Refund if any will be at the sole discretion of Repute Real Estate. RRE offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Users card/bank accounts. User acknowledges and agrees that RRE/ Boom Realtys, at its sole discretion and without prejudice to other rights and remedies that it may have under the applicable laws, shall be entitled to set off the amount paid or payable by a subscriber/user against any amount(s) payable by User to RRE under any other agreement or commercial relationship towards other products/services. Repute Real Estate gives no guarantees of server uptime or applications working properly. All is on a best effort basis and liability is limited to refund of amount only. Repute Real Estate undertakes no liability for free Services. Repute Real Estate. reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms / disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them.
• Repute Real Estate uses the maximum care as is possible to ensure that all or any data / information in respect of electronic transfer of money does not fall in the wrong hands. For completing online transactions involving payments a user is directed to a Payment Gateway, Repute Real Estate does not store or keep credit card data. Since the transaction happens on a third-party network not controlled by Repute Real Estate, once a credit card transaction has been completed, the payment information is not accessible to anyone at Repute Real Estate after completion of the on-line transaction at the Payment Gateway, this ensures the maximum security.
• If you've chosen an EMI option with your financial service provider, please note that the Company is not involved in that arrangement and will receive the full payment upfront.
• Where the bill-to, ship-to, and/or paying customer are different entities (for the purposes of this clause collectively, the "Customers"), each Customer jointly and severally represents and warrants that they have a valid and lawful internal arrangement authorizing their engagement with Repute Real Estate ("Company"). Each Customer agrees to fully indemnify and hold the Company harmless from any claims or liabilities arising from such inter-se arrangements. Each Customer shall promptly provide all required KYC documents of any or all Customers upon the Company's request. This contract shall be deemed accepted—without further act or communication—within one working day of: (a) the invoice date for the bill-to customer; (b) the payment date for the paying customer; and (c) subscription activation for the ship-to customer, unless a written objection is submitted to the Company within that period.
• Cash payments towards Subscription fees are strictly prohibited. The Subscriber shall not tender cash directly or indirectly to any person claiming to act on behalf of RRE nor deposit cash directly into RRE's bank account. Any such payment shall be invalid and shall not constitute discharge of the Subscriber's liability of making payments for any paid
• Repute Real Estate shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the user's account and / or information relating to or regarding online transactions using credit cards / debit cards and / or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.

6. Links to Third-Party Websites

Boom Realtys may provide links to other third-party World Wide Web sites or resources. RRE makes no representations whatsoever regarding any other website that you may access through Boom Realtys. Accessing such third-party websites is entirely at your own risk, and RRE is not responsible for the content, availability, or practices of any external websites.

7. Disclaimer and Warranties

Boom Realtys is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.

THE CONTENT OF BOOM REALTYS IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

RRE and third parties providing materials, services, or content through Boom Realtys disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, completeness, accuracy, timeliness, freedom from computer viruses, and any other warranties relating to the services, products, materials, or content available on Boom Realtys.

The views expressed by Users are their own. RRE does not endorse such views and shall not be responsible for them. While every reasonable effort is made to ensure that the content is not misleading, offensive, or inappropriate, RRE makes no guarantee regarding the accuracy or correctness of the information. If you notice any inaccurate or objectionable content, you are encouraged to report it through the appropriate abuse reporting channel.

It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, real estate listings, and other related information available on the website. RRE does not warrant that access to the website will be uninterrupted, error-free, or that any defects will be corrected.

RRE offers no guarantee or warranty that any listing or banner displayed on Boom Realtys will receive satisfactory responses or any response at all. Payments made to RRE/Boom Realtys are solely for the purpose of displaying the advertised property or related content.

Users are strongly advised to independently verify the authenticity of any pre-launch property offers. RRE does not endorse investment in projects that have not received official approvals or have not been formally launched by the respective Builder or Promoter. Users dealing with such projects do so entirely at their own risk and responsibility.

Nothing contained on Boom Realtys shall constitute an invitation or an offer to invest in RRE or any of its affiliates. Likewise, nothing on the platform should be interpreted as a recommendation to use any product, process, equipment, or formulation that may conflict with any patent or intellectual property rights. RRE makes no representation or warranty that such use will not infringe any patent or other rights.

Boom Realtys is controlled and operated from India. RRE makes no representation that the materials or services available on the platform are appropriate or available for use outside India. Users accessing the platform from other countries are solely responsible for compliance with all applicable local laws, regulations, international conventions, and treaties.

RRE offers products, services, content, and other functionalities through Boom Realtys and its affiliate websites in various regions worldwide. Services available in one region may differ from those offered in another due to availability, regional laws, legal restrictions, or other operational considerations. References on Boom Realtys to products, programs, or services that are unavailable in your country do not imply that RRE intends to launch or provide them in your jurisdiction.

8. Limitation of Liability

RRE shall not be liable for any damages of any kind arising out of or relating to the use of, or inability to use, Boom Realtys, its content, or any linked websites. This includes, without limitation, damages arising from errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, line failures, force majeure events, or any direct, indirect, incidental, special, punitive, exemplary, consequential, or loss of profit damages, whether based on contract, warranty, tort, or any other legal theory, even if RRE has been advised of the possibility of such damages.

RRE assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft, destruction, unauthorized access to, or alteration of any User's information or data. RRE shall also not be responsible for technical malfunctions relating to online systems, servers, providers, computer equipment, software, email failures, internet congestion, or any resulting damage to Users or their computer systems arising from the use of Boom Realtys.

For the purposes of the Consumer Protection Act, 2019 (CPA), the term Consumer shall be limited to paid Customers who have subscribed to Boom Realtys solely for personal use and not for commercial or business purposes.

Unless otherwise expressly specified, the sole performance obligation of RRE is to provide access to its online portal for the duration of the applicable subscription period. Any reference to usage limits or similar metrics merely indicates the maximum permitted consumption and shall not create any additional performance obligation on the part of RRE.

RRE shall not be liable for inaccuracies in information published on Boom Realtys. Any breach of privacy or disclosure of information provided by Users through technical or other means shall not be the responsibility of RRE. Furthermore, RRE does not guarantee the confidentiality of any information submitted to or accessed through Boom Realtys or any of its affiliated websites or domains.

9. Termination

RRE may, without prior notice and at its sole discretion, terminate or restrict your access to Boom Realtys or any part thereof at any time for any reason, including but not limited to situations where RRE believes that you have violated these Terms and Conditions, acted inconsistently with their intent, or breached any applicable law.

RRE further reserves the right to cancel transactions or take any other appropriate action if it determines that any transaction, activity, or conduct lacks transparency or raises concerns regarding authenticity, fairness, compliance, or legality. This includes, without limitation, suspected fraud, misrepresentation, misuse of systems or payment mechanisms, violations of applicable laws, inappropriate conduct toward RRE employees, or any activity that may expose RRE to financial, legal, reputational, or operational risk.

10. Indemnification

Submission or unauthorized use of any information or materials available on Boom Realtys may violate copyright, trademark, privacy, publicity, communications, or other applicable laws. You are solely responsible for your actions and for the actions of anyone using your username and/or password.

You agree to defend, indemnify, and hold harmless RRE, its associates, subsidiaries, officers, directors, employees, affiliates, licensors, business partners, and agents from and against any claims, actions, demands, damages, liabilities, losses, costs, and expenses (including reasonable legal and accounting fees) arising out of or relating to your use of Boom Realtys, your submitted content, your violation of these Terms and Conditions, or your breach of any applicable law.

RRE shall not be a party to any legal proceedings between parties who have entered into agreements or transactions through the Services. If RRE is made a party to any such legal proceedings, all associated costs and expenses shall be recoverable from the party that has impleaded RRE. RRE shall comply with any court order duly served upon it in accordance with applicable law.

11. Privacy Policy

The Privacy Policy of the Platform explains how we collect, use, process, and protect your personal data. We are committed to respecting your privacy and ensuring compliance with the Privacy Policy at all times.

The Platform provides various privacy settings that enable you to control how your profile information is displayed, who can view your information, and how you may be contacted by others.

Any feedback, suggestions, comments, or recommendations submitted by a User shall be deemed non-confidential and may be used by RRE without restriction or compensation.

12. Terms of Use for Users

• When you express interest in a Real Estate Listing or related services on Boom Realtys, you authorize Boom Realtys to contact you (including if you are registered with NDNC/DNC). You also authorize Boom Realtys to share your profile, personal details, application information, and relevant documents with the applicable advertiser, seller, or service provider. You further consent to being contacted via phone, email, WhatsApp, SMS, or similar communication channels. Once your data is shared, its use by third parties is governed by their respective privacy practices and not by Boom Realtys.
• By using Boom Realtys, you acknowledge that Boom Realtys is not responsible for the content, format, delivery method, or requirements of any advertiser's, seller's, broker's, or builder's application forms, messages, screening questions, assessments, or required documentation.
• You consent to Boom Realtys processing, storing, and analyzing your applications, documents, and communications in accordance with these Terms and the Privacy Policy. Boom Realtys may retain this information even if the relevant Real Estate Listing is no longer available and may use it to notify you of similar properties or services through calls, emails, SMS, or other communication channels, including where permitted under applicable regulations such as the National Preference Register (NCPR).
• Information that you publish in public areas of Boom Realtys or make visible through your profile may be accessed, stored, and used by individuals worldwide, including jurisdictions that may not provide equivalent data protection. While Boom Realtys takes reasonable security measures, it cannot control or be held responsible for the actions of third parties who access such information. Users should therefore avoid posting sensitive or confidential information publicly.
• It is solely your responsibility to configure and use the available privacy and opt-out settings to restrict access to your information where desired. RRE shall not be liable if your information is accessed by subscribers or users whose access has not been specifically restricted through your chosen privacy settings.
• You may choose to sign in to Boom Realtys using your Facebook or Google account. By doing so, you authorize Boom Realtys to access certain information associated with your social account, including your public profile information, in accordance with our Privacy Policy.

13. Terms and Conditions Specific for Dealers / Builders / Banks / Payment Gateways

• You shall comply with all applicable Data Protection Laws relating to the processing of personal data and shall ensure that such processing is lawful, relevant, and limited to the purposes described in the Privacy Policy and these Terms and Conditions.
• You shall implement appropriate technical and organizational security measures to protect all personal data shared by Boom Realtys against unauthorized access, unlawful processing, accidental loss, destruction, damage, alteration, or disclosure.
• You agree to provide all reasonable assistance necessary to facilitate the prompt handling, reporting, and resolution of any Data Security Breach in accordance with applicable data protection laws.
• You acknowledge that the responsibility for responding to requests from individuals regarding their personal data rests solely with the party that collects, stores, or processes such personal data.
• You represent and warrant that Personal Data received from Boom Realtys shall not be disclosed or transferred to any subcontractor or sub-processor unless adequate and equivalent safeguards are implemented to protect such Personal Data.
• You shall retain and process shared Personal Data only for the period necessary to fulfill the agreed business purposes and in accordance with applicable legal requirements.

14. Arbitration

If any dispute arises between a User and RRE in connection with the use of Boom Realtys, including any dispute relating to the validity, interpretation, implementation, or alleged breach of these Terms and Conditions, such dispute shall be referred to a sole Arbitrator who shall be an independent and impartial third party. The decision of the Arbitrator shall be final and binding upon both parties. The place of arbitration shall be Coimbatore, Tamil Nadu, India, and the arbitration proceedings shall be governed by the Arbitration and Conciliation Act, 1996.

15. Severability of Provisions

These Terms and Conditions constitute the agreement between you and RRE governing your use of Boom Realtys. If any provision of these Terms, or any part thereof, is held to be invalid, void, or unenforceable under any applicable law, regulation, governmental order, or final judgment of a competent court, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

16. Waiver

The failure of RRE to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision, nor shall it prevent RRE from exercising or enforcing the same at any later time.

17. Governing Law

By accessing or using Boom Realtys, you agree that these Terms and Conditions and all matters relating to the Platform shall be governed by and construed in accordance with the laws of India.

18. Jurisdiction

The courts situated in Coimbatore, Tamil Nadu, India shall have exclusive jurisdiction over all disputes arising out of or relating to Boom Realtys and these Terms and Conditions, irrespective of the place from which the Platform is accessed.

RRE does not routinely monitor content posted by Users on Boom Realtys but reserves the right to do so whenever necessary. If RRE becomes aware of any inappropriate, unlawful, or unauthorized use of the Platform or its Services, it may take any action that it deems appropriate in its sole discretion.

You acknowledge and agree that RRE may report any suspected illegal activities to the appropriate law enforcement authorities and may disclose any relevant information in its possession as required by law. RRE shall fully cooperate with law enforcement agencies in connection with investigations into alleged unlawful activities.

RRE expressly reserves all rights not specifically granted under these Terms and Conditions.

20. Amendment

Please report any violations of these Terms and Conditions to RRE at info@boomrealtys.com.
